Contest Terms and Conditions

AGREEMENT: These rules govern all Contests running on or sponsored by MobileFolk Inc. ("MobileFolk"). Prize details, additional instructions and, if necessary, additional rules, are set out on the contest page of www.oragepanel.com/contests/. No purchase is necessary to enter any Contest. The act of entering a Contest constitutes acceptance of the contest rules and the decisions of the contest judge.

ELIGIBILITY: The Contests are open to all residents of the United States, Canada (except in the province of Quebec), and the United Kingdom, who have attained the age of 18, excluding employees, immediate family (mother, father, sister, brother, child, spouse, grandparent, including step and foster relationships, but not including aunt, uncle, cousin, or other relative) and anyone living with any employee of MobileFolk, its corporate affiliates or, if applicable, any co-sponsor as described on the contest page of www.oragepanel.com/contests/, their advertising or promotional agencies or affiliates. Entrants must enter using their iPhone, iPod, or iPad device to download the OrangePanel iPhone app and register for an OrangePanel account using accurate information. Entrants must correctly answer a skill-testing question before the prize is awarded. Entrants must have a valid iTunes account to redeem the prize.

PRIZE: Details about the prize and the award process can be found on the contest page of www.oragepanel.com/contests/. Odds of winning depend on the number of eligible entries submitted during the contest period. Selected entrants will be contacted by email at the email address listed on the entrant's OrangePanel profile. If a selected entrant cannot be reached within three (3) business days of the draw, incorrectly answers the skill-testing question, declines the prize, or fails to return a Release of Liability as be specified below, another entrant will be selected in his or her place from the same pool of entrants.

WINNER: To be declared a winner, selected entrants must first correctly answer, unaided, a time-limited, skill-testing question posed by email, and must provide MobileFolk with their name, city and country of residence, and a valid email address where they wish to receive the iTunes Gift Card.

RELEASE: The winner will be required to agree, via email, to an affidavit of eligibility and release form releasing MobileFolk of all liability, confirming compliance with the rules and consenting to the use of his or her name and city of residence, without further compensation, in any publicity carried out by the sponsors and / or their advertising and promotional agencies. By entering this Contest, entrants release and hold harmless MobileFolk, the contest suppliers and the contest judges, their affiliates and respective directors, officers, owners, partners, employees, agents, dealers, representatives, successors and assigns (collectively the "Releasees") from any liability in connection with this contest or, if declared a winner, the prize.

PRIVACY: Personal information provided when entering this contest is subject to the privacy terms specified while registering for OrangePanel. In addition, we may use this information to contact you about this contest or future contests administered by MobileFolk.

BANNING: MobileFolk may, in its sole discretion, prohibit any person from entering any contest that we believe to be abusing the rules. Such abuse includes entering false information.

OTHER:

All decisions of the contest judge are final. Contests are governed by the laws of Ontario and the laws of Canada applicable therein. The sponsors reserve the right to cancel or modify any contest or the contest rules at any time without notice. Prizes are non-transferable, not convertible to cash and must be accepted as awarded. The sponsors reserve the right to substitute any prize or portion of the prize with a prize of equal or greater value. All prizes are awarded as-is and no warranties or guarantees are implied or expressed, beyond the standard manufacturer's warranty. The odds of winning depend on how many eligible entries are received. MobileFolk is not liable for any errors, damage or negligence that may arise in connection with this contest, including technical failures on the part of contest software, website down-time, human error or property damage incurred by any contest entrant.

If the identity of an entrant is disputed, the authorized account holder of the e-mail address or of the OrangePanel account at the time of entry will be deemed to be the entrant. The individual assigned to the e-mail address for the domain associated with the submitted e-mail address or to the OrangePanel account is considered the authorized account holder. A selected entrant may be required to provide proof of being the authorized account holder associated with the selected entry. All entries must be submitted from a valid e-mail associated with an OrangePanel account. The sole determinant of time for the purposes of receipt of a valid entry in this Contest will be the contest server machine(s) and the MobileFolk network.

MobileFolk assumes no responsibility for failure of the internet or the website during the promotional period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any email or traffic congestion on the internet or at any website, or any combination thereof including any injury or damage to an entrant's or any other person's computer related to or resulting from playing or downloading any material in the promotion. MobileFolk reserves the right, in its/their sole discretion, to cancel or suspend the email portion of this Contest should a virus, bug or other cause beyond their reasonable control corrupt the security or proper administration of the Contest. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws. Should such an attempt be made, Contest Sponsors reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
